Understanding no win, no fee agreements

A no win, no fee agreement, otherwise known as a ‘conditional fee’ agreement, is an arrangement between you (the client) and your solicitor when making a legal claim. Simply put it means that should your claim be unsuccessful, you will not be liable to pay the fees for your solicitor’s services (as long as you have co-operated and followed their advice). You will only pay legal fees if your claim is successful.

How no win, no fee arrangements work

When entering into a no win, no fee agreement we will complete an initial assessment of your claim, advising you on the merits of your case. If we do not feel that your case is worth pursuing we will advise you, along with the reasons why.

If you have a viable claim, which we can handle on a no win, no fee basis, we will take out an insurance policy on your behalf. The insurance policy, known as After the Event insurance (ATE) is in place to cover any additional costs incurred, such as court fees or medical report payments. The policy protects you against these risks and means that, whether you win or lose, provided you comply with the terms of the policy, you will not have to pay your opponents legal costs. Your claims handler will fully explain the terms of the policy to you at the start of the claims process.
